Acquiring Immovable Property in Malta

Are you looking to invest in Malta, but unsure because you are not a citizen of Malta? Chapter 246 of the Laws of Malta regulates the acquisition of immovable property by non-residents. The basic rules relating to foreigners can be divided into three branches:  

  1. Rules for EU citizens who have lived in Malta for at least five years: Can purchase more than one property in Malta without the need of acquiring an AIP permit. 
  2. Rules for EU citizens who have not lived in Malta for at least five years: Can buy a single dwelling house with the intention of living here. They can also purchase business premises without the need to acquire any AIP permit. 
  3. Rules for Non-EU citizens: The latter can only acquire a single property after they have received authorisation to purchase in the form of an AIP Permit which is issued by the Government of Malta. An exception arises in the case of the purchase of immovable property in a Special Designated Area.
